Welcome to TermSheet360. These Terms of Service ("Terms") govern your use of the TermSheet360 platform, website, and services (collectively, the "Service") operated by TermSheet360 ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account, accessing, or using TermSheet360, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
TermSheet360 is a software-as-a-service (SaaS) platform that enables private lending companies to generate, manage, and distribute term sheets for real estate loan products. The Service includes term sheet generation, pricing engine configuration, pipeline management, and related tools.
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
Access to the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice.

You retain all rights to the data you input into the Service, including loan details, borrower information, company branding, and generated term sheets. We do not claim ownership of your data. We may use aggregated, anonymized data for analytics and product improvement purposes.
We understand that the data processed through our platform is sensitive financial information. We implement industry-standard security measures to protect your data and will not disclose your data to third parties except as required by law or as necessary to provide the Service.
TermSheet360 is a document generation tool. The term sheets produced by the Service are for informational purposes and do not constitute legal, financial, or investment advice. You are solely responsible for ensuring that all generated documents comply with applicable federal, state, and local lending regulations. We recommend that all term sheets be reviewed by qualified legal counsel before distribution.
To the maximum extent permitted by law, TermSheet360 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.
Either party may terminate this agreement at any time. You may cancel your subscription through your account settings. Upon termination, your access to the Service will cease, and we will retain your data for 30 days before deletion, during which time you may request an export of your data.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
